Full textDecedents dying in 2010 are not subject to estate or generation skipping tax (at present), however, many have executed Wills and other estate planning documents which contemplated certain amounts which could be exempted from estate tax due to anticipated exclusion amounts which no longer exist. Depending upon how those documents were drafted, drastically unintended results could occur for decedents dying in 2010, such as total disinheritance of a surviving spouse because a maximum amount which may be passed free of federal estate tax is directed to be placed into a trust or passed on to children rather than given outright to the spouse.
